– Product descriptions are provided in good faith but may contain typographical errors or inaccuracies. We reserve the right to correct any errors and to update product information at any time without notice.
– We reserve the right to limit the sale of our products to any person, geographic region, or jurisdiction, and to discontinue any product at any time.
4. Pricing & Availability
All prices are displayed in the currency shown at checkout and are inclusive of applicable VAT where required by EU law. Prices are subject to change without notice.
Product availability is not guaranteed. In the event that an ordered item is out of stock or unavailable after your order is placed, we will notify you as soon as possible and offer either an alternative, a back-order option, or a full refund.
Nesté reserves the right to refuse or cancel any order at our discretion, including but not limited to cases of suspected fraud, pricing errors, or abuse of promotional offers. If your order is cancelled after payment, you will receive a full refund within 14 days.
5. Orders & Payment
By placing an order, you confirm that:
– All information you provide is accurate and complete;
– You are authorised to use the payment method provided;
– The order is placed for personal, non-commercial use unless otherwise agreed in writing.
Order confirmation via email does not constitute final acceptance of your order. We reserve the right to decline any order after confirmation if circumstances require it (e.g., a pricing error or stock discrepancy). In such cases, you will be notified promptly and any payment refunded in full.
We use third-party payment processors. By submitting payment information, you agree to their respective terms and authorise us to charge the applicable amount. We do not store full payment card details on our servers.
6. Shipping & Delivery
Nesté ships worldwide. By placing an order, you acknowledge and agree to the following:
– Delivery estimates: Delivery estimates are indicative only and not guaranteed. Transit times vary by destination and carrier.
– Delays: We are not liable for delays caused by customs clearance, carrier disruptions, natural events, or other circumstances beyond our reasonable control.
– Import duties: Import duties, taxes, and customs fees may apply depending on your destination country. These charges are the sole responsibility of the customer and are not included in our pricing. We recommend checking your local customs regulations before ordering.
– Risk of loss: Risk of loss passes to you upon handover to the carrier. If your order is marked as delivered but not received, please contact us promptly so we can assist in filing a claim with the carrier.
– Incorrect address: Nesté is not responsible for orders that cannot be delivered due to an incorrect address provided at checkout. Additional shipping costs may apply for re-delivery.

7. Right of Withdrawal (EU Customers)
If you are a consumer located in the European Union, you have the right to withdraw from your purchase without giving any reason within 14 calendar days of receiving your order (the “cooling-off period”). This right is provided under the EU Consumer Rights Directive.
To exercise your right of withdrawal, you must notify us before the 14-day period expires by contacting us at support@nestesleep.com with a clear statement of your decision to withdraw (including your order number).
Exceptions: The right of withdrawal does not apply to:
– Products that have been used, washed, or are not in their original condition;
– Products returned without original packaging where this affects resale value;
– Sealed goods that have been unsealed after delivery and cannot be returned for hygiene reasons (where applicable).
Upon valid withdrawal, we will refund all payments received from you, including standard delivery costs (but not any additional costs for non-standard shipping), within 14 days of receiving the returned goods or confirmation of return, using the same payment method you used for the original transaction.
Return shipping costs are your responsibility unless the product is defective or the return is the result of our error.
8. Returns & Refunds
Beyond your statutory right of withdrawal, we want you to be satisfied with your Nesté purchase. Please refer to our Refund Policy for full details on eligibility, timeframes, and the return process, including how to initiate a return.
Refunds will be issued to the original payment method within the timeframe specified in our Refund Policy, unless otherwise agreed.
9. Defective or Incorrect Items
If you receive a product that is defective, damaged, or not as described, you must notify us at support@nestesleep.com within 30 days of receipt, providing your order number and photographic evidence where possible.
We will, at our discretion and in accordance with applicable consumer protection law, offer:
– A replacement of the defective item;
– A repair (where applicable);
– A full or partial refund.
Your statutory consumer rights under Dutch and EU law are not affected by these terms.
10. Intellectual Property
